Terms of Service

These Terms of Service (“Terms”) govern the use of website development and related digital services provided by Moncer Studio (“Moncer Studio”, “we”, “our”, or “us”).
By purchasing, accessing, or using our services, you (“Client”, “you”, or “your”) acknowledge that you have read, understood, and agreed to be bound by these Terms.

Moncer Studio provides professional digital services, including but not limited to website development, website maintenance, SEO services, WordPress development, technical consultation, and other related services.

1. The scope of work shall be defined in the applicable proposal, quotation, invoice, service package, or written agreement.
2. Any request outside the agreed scope may require additional fees, revised timelines, or a separate agreement.
3. Moncer Studio reserves the right to decline requests that fall outside the agreed scope of work.

1. The Client shall provide accurate, complete, and timely information required for project execution.
2. The Client is solely responsible for all content, images, trademarks, logos, documents, credentials, and materials submitted to Moncer Studio.
3. The Client warrants that all submitted materials do not infringe any copyright, trademark, intellectual property right, or applicable law.
4. The Client agrees to provide feedback, approvals, and requested materials within a reasonable timeframe.
5. The Client shall make payments according to the agreed payment schedule.

1. Revision allowances are determined by the selected service package.
2. Minor revisions include text updates, image replacements, color adjustments, section reordering, and minor layout refinements.
3. Revisions do not include substantial redesigns, structural changes, new features, additional functionality, or changes beyond the original project scope.
4. Revision timelines depend on project complexity and current workload.
5. Requests involving changes exceeding fifty percent (50%) of the approved design or structure may be treated as a new project and billed separately.
6. Additional revisions requested after website launch may incur additional fees.
7. The Client agrees not to make direct modifications to the website while revisions are being implemented by Moncer Studio.

1. Maintenance services are provided according to the selected package.
2. Maintenance includes technical support and services specifically outlined within the purchased package.
3. Content updates apply only to content modifications and do not include major design or functionality changes.
4. Content update allowances are determined by the selected package.
5. One content update request applies to a single webpage. Multiple changes within the same page count as one request.
6. Unused maintenance or content update allowances cannot be carried forward to future periods.
7. Complimentary maintenance services are available only for websites hosted under Moncer Studio’s managed hosting environment.
8. Clients using external hosting providers may be charged separately for maintenance and content update requests.

1. To maintain service stability and security, hosting control panel access is not provided by default.
2. Hosting or cPanel access may be granted upon request and at Moncer Studio’s discretion.
3. If access is granted, the Client assumes full responsibility for all actions performed through such access.
4. Moncer Studio shall not be responsible for website issues, malware infections, data loss, security breaches, or downtime resulting from Client modifications.
5. Recovery work required due to Client actions may be subject to additional charges.

1. Domain names must comply with applicable laws and must not infringe trademarks, intellectual property rights, or third-party rights.
2. The Client is solely responsible for the domain name selected and registered.
3. Moncer Studio shall not be liable for disputes, claims, or legal actions arising from domain ownership or usage.
4. Violations of domain registration policies may result in suspension or cancellation without refund.

1. Projects may utilize third-party themes, plugins, software, APIs, or services.
2. Some third-party products require separate licensing fees and periodic renewals.
3. The Client is responsible for maintaining active licenses when required.
4. Failure to renew licenses may impact website functionality, security, or compatibility.
5. Moncer Studio shall not be responsible for changes, discontinuations, licensing restrictions, pricing changes, or technical issues introduced by third-party vendors.

1. All Client-owned content, trademarks, logos, and materials remain the property of the Client.
2. Ownership of the completed website shall transfer to the Client only after full payment has been received.
3. Moncer Studio reserves the right to showcase completed projects within its portfolio, case studies, marketing materials, and promotional content unless otherwise agreed in writing.
4. The Client may not reproduce, redistribute, resell, or reuse proprietary Moncer Studio assets without prior written permission.

Moncer Studio does not provide services for websites involving:

• Gambling activities
• Adult or pornographic content
• Fraudulent or deceptive schemes
• Phishing, malware, bots, auto-like, auto-follow, or similar systems
• Pyramid schemes or Ponzi schemes
• Hate speech, harassment, discrimination, or unlawful content
• Copyright infringement
• Activities prohibited under applicable laws

Moncer Studio reserves the right to reject, suspend, or terminate any project that violates these restrictions.

1. Project work begins after payment confirmation.
2. Payment schedules are defined within the applicable proposal, quotation, invoice, or agreement.
3. Final payment must be completed before full project handover or website launch.
4. Late payments may result in project delays, service suspension, or temporary service interruption.
5. Hosting, maintenance, domain registration, and other recurring services require timely renewal payments.
6. Failure to renew services within thirty (30) days after expiration may result in suspension, termination, or deletion of associated data.

1. Refunds may be granted only if Moncer Studio is unable to deliver the agreed services.
2. Refund requests are not accepted once the project has been active for more than seven (7) days.
3. Refunds are not available after a website has been completed, published, or launched.
4. Refunds are not available for cancellations caused by Client decisions, business changes, or failure to provide required materials.
5. If cancellation occurs after initial concepts, mockups, or design drafts have been delivered, any refund amount shall be determined at Moncer Studio’s sole discretion.
6. Refunds will not be provided for projects involving illegal activities.
7. Refunds shall not apply to domain registrations, hosting services, SSL certificates, premium themes, premium plugins, software licenses, advertising spend, transaction fees, or any third-party products and services purchased or activated on behalf of the Client. Such costs are non-refundable once incurred, as payments are made to external providers and cannot be recovered by Moncer Studio.

1. Moncer Studio may perform backups according to the hosting or maintenance package selected.
2. While reasonable precautions are taken, Moncer Studio does not guarantee complete protection against data loss.
3. Moncer Studio shall not be liable for data loss caused by hardware failure, cyberattacks, third-party service failures, user error, or force majeure events.
4. The Client is encouraged to maintain independent backups of critical data.

Moncer Studio shall not be liable for any indirect, incidental, special, consequential, punitive, or business-related damages arising from the use of any website, service, or deliverable provided.

Moncer Studio’s total liability shall never exceed the total amount paid by the Client for the specific service giving rise to the claim.

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, government actions, war, civil unrest, pandemics, power outages, internet disruptions, labor disputes, or other force majeure events.

1. Moncer Studio will take reasonable measures to protect confidential information provided by the Client.
2. Confidential information shall not be disclosed to third parties except where required by law or necessary for service delivery.
3. The Client acknowledges that electronic communications and online systems cannot be guaranteed to be completely secure.

1. Any dispute arising from these Terms shall first be resolved through good-faith negotiations between the parties.
2. If no resolution can be reached, the dispute shall be submitted to the competent courts of the Republic of Indonesia.

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.

1. Moncer Studio reserves the right to update or modify these Terms at any time.
2. The latest version will always be available through our official website.
3. Continued use of our services constitutes acceptance of any updated Terms.
